Passenger entitlement to compensation
As a passenger in any vehicle involved in an accident, unless you contributed towards the accident in some way, in the eyes of the law you will be viewed as an innocent party and will be able to make a claim for compensation.

The amount of compensation to which you are entitled can be reduced if you were not wearing a seatbelt, as the law states you must wear a seatbelt when travelling in a vehical.  Even if you were not wearing a seatbelt, it is worth making a claim as you will still be eligible for the majority of your compensation.

At the scene of an accident
If you are involved as a driver or passenger in an accident, if you are able at the scene you should:

-          Take the name, telephone number and address of any other drivers involved, as well as the registration number of their vehicles

-          Take the names, telephone number and addresses of any witnesses

-          Take photos of the scene or sketch it as soon after the road accident as possible

-          If you are a taxi driver then you must take the name and address of your passengers as firstly they are very important witnesses of the accident and secondly if you are injured then it’s very likely that they are injured too.

-          If you are a passenger in a taxi you must also take the name and address of the taxi driver, the name and phone number of the taxi company and the registration number of the taxi.

-          Taking these steps will make claiming compensation more straightforward as tracking down witnesses after the event can sometimes be difficult.  The exact details of where the cars were positioned and what happened in the accident are easily misremembered and sometimes disputed by the other driver, so it is important to either have photographs or a written account on paper to support your claim.
